South Africa vs. Israel

In late 2023, South Africa filed a landmark case at the International Court of Justice (ICJ), alleging that actions in the Gaza Strip violated the 1948 Genocide Convention. This case brought the attention of the entire world to the legal definitions of state responsibility and human rights.

Provisional Measures (January 2024)

The ICJ issued a preliminary ruling ordering the prevention of acts of genocide, the punishment of public incitement to genocide, and the immediate enabling of basic services and humanitarian assistance to Gaza.

Advisory Opinion (July 2024)

In a separate historic advisory opinion, the ICJ addressed the legal consequences of the decades-long policies and practices. The court's findings were monumental for international law:

Unlawful Occupation: The court declared that the presence in the occupied territories is unlawful under international law.
End of Occupation: It stated that the occupation must be brought to an end as rapidly as possible.
Settlement Policy: The court reaffirmed that the transfer of settlers and the maintenance of settlements violate the Fourth Geneva Convention.
Reparations: It ruled that there is an obligation to provide full reparations for the damage caused by the unlawful acts.
